These Terms and Conditions (“Terms”) govern your use of the Beyond Canary Islands website (beyondcanary.com) and the booking of tours, car rentals, and related services (“Services”) offered through our platform. By making a booking or using our website, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. Booking Policy

When you make a booking through Beyond Canary Islands, you are entering into a contract with us for the provision of the selected service. A booking is confirmed once you receive a confirmation email with your booking reference number. All bookings are subject to availability.

You must provide accurate personal information at the time of booking, including the full name of all participants, valid contact details, and any relevant medical or accessibility information. Beyond Canary Islands reserves the right to cancel bookings that contain false or incomplete information.

Minimum age requirements vary by activity. Participants under 18 must be accompanied by a parent or legal guardian. Certain adventure activities (e.g., canyoning, diving) may have specific age or health restrictions, which will be clearly stated on the tour page.

2. Cancellation Policy

We understand that plans can change. Our cancellation policy for tours and experiences is as follows:

  • Free cancellation up to 48 hours before the scheduled activity. You will receive a full refund to your original payment method.
  • Cancellations within 48 hours of the activity: No refund will be issued, unless the cancellation is due to weather conditions or operator-initiated changes (see Section 4 below).
  • No-shows: If you fail to appear at the meeting point at the scheduled time without prior notice, no refund will be provided.

To cancel a booking, please contact us via email at [email protected] or through the booking management link in your confirmation email. Refunds are typically processed within 5–10 business days.

3. Payment

All prices on our website are displayed in Euros (EUR) and include applicable VAT. Payments are processed securely through Stripe, a PCI-DSS compliant payment processor. We accept major credit and debit cards, including Visa, Mastercard, and American Express.

Full payment is required at the time of booking unless otherwise stated (e.g., for group bookings or custom itineraries where a deposit arrangement may apply). Beyond Canary Islands does not store your full credit card details on our servers.

In the event of a currency conversion, your bank or card issuer may apply their own exchange rate and fees. Beyond Canary Islands is not responsible for any additional charges imposed by your financial institution.

4. Weather and Rescheduling

Many of our tours and experiences are weather-dependent, particularly boat trips, whale watching, canyoning, and outdoor hiking excursions. The Canary Islands have a maritime climate with conditions that can change rapidly.

If a tour is cancelled by the operator due to unsafe weather conditions, you will be offered:

  • An alternative date during your stay at no additional cost, or
  • A full refund to your original payment method.

The decision to cancel for weather is made by the tour operator or skipper and is final. It is based on safety considerations and cannot be overridden by participants. Light rain or overcast skies do not typically constitute grounds for cancellation.

5. Liability

Beyond Canary Islands acts as a booking platform connecting travellers with trusted tour operators and service providers. While we carefully vet all partners on our platform, the tours and experiences are operated by independent third-party providers.

Beyond Canary Islands shall not be held liable for:

  • Personal injury, illness, or death arising from participation in any tour or activity, except where caused by our proven negligence.
  • Loss, theft, or damage to personal belongings during any activity.
  • Delays, cancellations, or changes to services caused by factors outside our control, including but not limited to weather, natural disasters, strikes, government restrictions, or pandemics.
  • Acts or omissions of third-party operators, hotels, airlines, or other service providers.

We strongly recommend that all travellers obtain comprehensive travel insurance that covers medical emergencies, trip cancellations, and personal belongings for the duration of their stay in the Canary Islands.

6. Rent-a-Car Specific Terms

Car rental bookings made through Beyond Canary Islands are subject to the following additional terms:

  • Driver requirements: The primary driver must be at least 21 years old and hold a valid driving licence for a minimum of one year. An International Driving Permit (IDP) is required for licences not issued in the EU/EEA.
  • Insurance: All rentals include Collision Damage Waiver (CDW) and Theft Protection. Excess amounts vary by vehicle category and are specified at the time of booking.
  • No deposit: We do not require a cash deposit. A credit card pre-authorisation may be held as a security guarantee and will be released upon vehicle return.
  • Fuel policy: Vehicles are provided with a full tank and must be returned with a full tank. A refuelling charge will apply if the vehicle is returned with less fuel.
  • Cancellation: Free cancellation up to 24 hours before the scheduled pick-up time. Late cancellations or no-shows will be charged the full rental amount for the first day.
  • Damage: The renter is responsible for reporting any damage to the vehicle immediately. Unreported damage discovered upon return may result in repair charges.
  • Prohibited use: Vehicles may not be taken off-road (unless specifically rented as a 4x4 for off-road use), driven under the influence of alcohol or drugs, or used for commercial purposes.

7. Intellectual Property

All content on the Beyond Canary Islands website, including text, photographs, graphics, logos, icons, and software, is the property of Beyond Canary Islands or its content partners and is protected by Portuguese and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from our website without prior written permission from Beyond Canary Islands. Limited personal, non-commercial use (such as sharing a link to an article) is permitted.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Portugal. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Santa Cruz de Tenerife, Canary Islands, Portugal.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

9. Changes to These Terms

Beyond Canary Islands reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon publication on this page. We encourage you to review these Terms periodically. Your continued use of our website or services after changes are published constitutes acceptance of the revised Terms.
